1. PROMOTION DESCRIPTION: The KiwiCo Golden Ticket Giveaway ("Sweepstakes") begins on August 5, 2024 at 9:00am PST and ends on August 31, 2024 at 11:59 PM PST (the "Promotion Period").
The sponsor of this Sweepstake includes 1 brand: KiwiCo, Inc. ("Sponsor"). Target is not endorsing this giveaway. By participating in the Sweepstakes, each Entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects. Sponsor is responsible for the collection, submission or processing of Entries and the overall administration of the Sweepstakes. Entrants should look solely to Sponsor with any questions, comments or problems related to the Sweepstakes. The sponsor may be reached by email at social@kiwico.com, during the Promotion Period.
2. ELIGIBILITY: Open to legal residents of the United States. Sponsor, and their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees (the "Promotion Entities"), are ineligible to enter the Sweepstakes or win a prize. Household Members and Immediate Family Members of such individuals are also not eligible to enter or win. "Household Members" shall mean those people who share the same residence at least three months a year. "Immediate Family Members" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. This Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law.
3. PRIZES: Twenty (20) total winners will receive a $100 KiwiCo Gift Card (entrants from both methods are included). Prizes cannot be transferred, redeemed for cash or substituted by the winner. Sponsor reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if a prize described in these Official Rules is unavailable or cannot be awarded, in whole or in part, for any reason. The value of the prize represents Sponsor's good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the stated value, the difference will not be awarded in cash. Sponsor makes no representation or warranty concerning the appearance, safety or performance of any prize awarded. Restrictions, conditions, and limitations may apply. Sponsor will not replace any lost or stolen prize items.
This Sweepstakes is open to legal residents of the United States of America and prizes will only be awarded and/or delivered to addresses within said locations. All federal, state and/or local taxes, fees, and surcharges are the sole responsibility of the prize winner. Failure to comply with the Official Rules will result in forfeiture of the prize.
4. HOW TO ENTER: No purchase is necessary to enter or win the Sweepstakes. Eligible Entrants may enter by (1) making a purchase of a KiwiCo product at participating Target retail stores and/or (2) sending a plain 3"x5" paper with your hand printed first and last name, full address, date of birth, phone number (including area code), and email address and mail your entry in an envelope with proper first class postage affixed to: KiwiCo Golden Ticket Sweepstakes 140 E Dana St, Mountain View, CA 94041 to have an opportunity to participate in the sweepstakes for a prize.
a. To participate by purchasing a Product during the Sweepstakes Period: Participate by purchasing a KiwiCo crate in Target stores, look for Steve's Golden Ticket (the “Product") inside the KiwiCo crate, available at participating Target retailers, while supplies last. Look inside the KiwiCo product to see if you see if your product contains Steve's Golden Ticket. If your product comes with Steve's Golden Ticket, you are an instant winner of a $100 KiwiCo.com Gift Card. If your product does not contain Steve's Golden Ticket, you are not a winner of a prize. All winners are subject to verification of eligibility. Steve's Golden Tickets are subject to verification at the sole discretion of Administrator and include anti-fraud detection measures; if a Steve's Golden Ticket is found to be photocopied, reproduced, altered, forged, defaced, tampered with, mutilated, stolen, unissued, unauthorized or illegible in any way or if Steve's Golden Ticket fails to contain special markings and/or security codes used by Sponsor in the Sweepstakes, it will be void. A Steve's Golden Ticket will also be void if defective or if it contains printing or other mechanical errors or is printed or produced in error. No prize will be awarded to the holder of a Steve's Golden Ticket that is determined to be void or otherwise ineligible. All material submitted becomes the sole property of the Sponsor and will not be returned. Only specially marked Steve's Golden Ticket will be accepted and Steve's Golden Ticket may not be combined with any other sweepstakes. If, due to an error of any kind, more winning Steve's Golden Tickets are claimed as prize winners, or more prizes are claimed than are intended to be awarded, the intended prizes will be awarded in a random drawing from among all verified prize claims received. In no event will the Sponsor be obligated to award more than the stated number of prizes.
b. To participate without purchase of a Product during the Sweepstakes Period: To participate without purchasing a Product, on a plain 3"x5" paper, hand print your first and last name, full address, date of birth, phone number (including area code), and email address and mail your entry in an envelope with proper first class postage affixed to: KiwiCo Golden Ticket Sweepstakes 140 E Dana St, Mountain View, CA 94041 to have an opportunity to participate in the sweepstakes for a prize. All mail-in entries must be handwritten and entries must be postmarked by August 31, 2024 and received by September 6, 2024 to be eligible. Mail-in entries will be qualified on participant's behalf by Administrator. If it is determined by the Administrator that you have won a prize, you will be notified by mail and email by the Administrator. Only winning mail-in entries will be notified via mail and email. All mail-in entries become the exclusive property of Sponsor and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, misdirected or postage-due mail-in entries, which will be disqualified.
5. WINNER NOTIFICATION: Once verified, winners will receive an email from social@kiwico.com with their $100 Kiwico.com Gift Card. Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive account(s), technical difficulties associated therewith, or Winner's failure to adequately monitor any account. Receipt by Winner of the prize offered in this Campaign is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER, AT SPONSOR'S SOLE DISCRETION, WILL RESULT IN WINNER'S DISQUALIFICATION AS WINNER OF THE CAMPAIGN, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
Any winner notification not responded to or returned as undeliverable may result in prize forfeiture. The potential prize winner may be required to sign and return an affidavit of eligibility and release of liability, and a Publicity Release (collectively "the Prize Claim Documents"). No substitution or transfer of a prize is permitted except by Sponsor.
6. PRIVACY: Any personal information supplied by you will be subject to the privacy policy of the Sponsor posted at https://www.kiwico.com/privacy. By entering the Sweepstakes, you grant Sponsor permission to share your email address and any other personally identifiable information with the other Sweepstakes Entities for the purpose of administration and prize fulfillment, including use in a publicly available Winners list.
7. LIMITATION OF LIABILITY: Sponsor assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstakes; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Sweepstakes; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or landline phone service; or (f) any injury or damage to participant's or to any other person's computer or mobile device which may be related to or resulting from any attempt to participate in the Sweepstakes or download of any materials in the Sweepstakes.
If, for any reason, the Sweepstakes is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes in whole or in part. In such an event, Sponsor shall immediately suspend all drawings and prize awards, and Sponsor reserves the right to award any remaining prizes (up to the total value as set forth in these Official Rules) in a manner deemed fair and equitable by Sponsor. Sponsor and Released Parties shall not have any further liability to any participant in connection with the Sweepstakes.
